IX.-3:301: European register of proprietary security; other systems of registration or notation
(1) A registration that is required or allowed for any security right or retention of ownership device under the rules of this Book is to be effected in a European register of proprietary security, subject to paragraph (2).
(2) Where systems of registration or notation on title certifieates for security rights in specifie types of assets exist, the effectiveness of a security right to be registered or noted in these systems depends upon compliance with any mandatory rules applicable for these systems. For systems established under the national law of a member state, this rule is subject to IX.-3:312 (Transitional provision in relation to entries in other systems of registration or notation under national law).
(4) An entry of security rights in financial instruments into a register maintained by or for the issuer of financial instruments or which under national law is determinative of title is not regarded as registration for the purposes of this Seetion but may constitute control if the requirements of IX.-3:204 (Control over financial assets) paragraph (3) are complied with.
IX.-3:301: Европейский реестр реальных обеспечений; другие системы регистрации или учета
(1) Регистрация обеспечения залогового типа или удержания титула, которая требуется или принимается во внимание в соответствии с правилами настоящей Книги, производится в Европейском реестре реальных обеспечений с учетом правил пункта (2).
(2) Если существует система регистрации или учета обеспечений залогового типа в отношении отдельных видов имущества, действие обеспечения, подлежащего регистрации или учету в соответствующей системе, зависит от соблюдения установленных для этой системы императивных правил. Для систем, учрежденных по национальному законодательству государств-участников, это правило применяется с учетом Статьи IX.-3:312 (Переходные положения, касающиеся записей в иных системах регистрации или учета, созданных по национальному законодательству).

(3) Запись об обеспечительных правах залогового типа в отношении финансовых инструментов в реестре, который ведется эмитентом инструмента или для него либо регистрация в котором в соответствии с национальным законодательством необходима для признания права на инструмент, не рассматривается как регистрация для целей применения настоящего Раздела, но при соблюдении требований пункта (3) Статьи IX.-3:204 (Контроль над финансовыми активами) может подтверждать наличие контроля.
IX.-3:302: Structure and operation of the register
(1) The European register of proprietary security is to operate as a personal folio system, allowing entries ecneeming security rights to be filed against identified security providers.
(2) The register is to operate electronically and to be directly accessible for its users in an online format.

(1) Европейский реестр реальных обеспечений должен строиться по системе учета лиц с возможностью внесения записей об обеспечениях залогового типа в отношении конкретных обеспечительных кредиторов.
(2) Реестр следует вести в электронной форме с возможностью для пользователей прямого доступа в режиме online.
IX.-3:303: Retention of ownership devices and security rights
(1) For the purposes of the European register of proprietary security no distinction is made between retention of ownership delices and security rights.

(2) Any reference in this Section to security rights includes retention of ownership devices.
IX.-3:303: Удержание титула и обеспечения залогового типа
(1) Для целей ведения Европейского реестра реальных обеспечений различия между удержанием титула и обеспечениями залогового типа отсутствуют.
(2) Любая ссылка в настоящем Разделе на обеспечения залогового типа включает и ссылку на удержание титула.
IX.-3:304: Authentication as requirement for declarations to the register
(1) Any declaration to the online register, such as filing, amending or deleting an entry in the register or a declaration of consent, requires authentication by the person making the declaration.
(2) Authentication requires:
(a) the use of login information which is issued to individual users of the online register after an initial enrolment in the register during which the identity and the contact details of the user are verified; or
(b) the use of secure online identity vernation systems of general application, if such systems are brought into operation at a European or member state level.
