Letter to the Ship Agent claiming the Shippers' responsibility for their refusal to supply the cargo

Dear Sirs,

In accordance with the instructions from our Agents in Port Said, Messrs. Reel & Co., Ltd., we have arrived here to receive 3,000 bales of Cotton to be shipped to Italy by Messrs. Laheta & Co., Ltd., Cotton Producers, Alexandria, under the Charter Party dated the 12th July, 20 . . .

As you know, my m/v "Chulym" arrived in your port at 13.00 hours on the 25th inst. and berthed at Berth No.37 at 14.00 hours on the same day. A due written Notice of Readiness was for­warded to the above mentioned firm through you at 16.00 hours on the 24th July, 20 . . .

We learn now that the Shippers, Messrs. Laheta & Co., Ltd., have refused to accept our notice and to supply any cargo, stat­ing that they have no definite orders from the Charterers.

In the circumstances I have to consider this refusal as a breach of the contract terms and I have to lodge an official Sea Pro­test at your local Notary Office. In this connection I would kindly ask you to state your opinion and give evidence to this end at the Notary Public.

You will greatly oblige me by acknowledging the receipt of this letter.

2.Letter advising that although the laydays and days on demur­rage have expired a full load has not yet been supplied

This is to bring to your notice that the laydays for load­ing my vessel expired yesterday, the 11th April, 20 . . .

As up to date you have not supplied full cargo to my ves­sel I hereby request you to let me know whether you intend to load any more cargo at all.

Please note that in accordance with the Charter Party terms under these circumstances you will be held liable for the deten­tion, dead-freight and damages incurred through your not supplying full cargo.

Letter to the Agent claiming: responsibility for the damage to the goods through careless handling by stevedores

Dear Sirs,

Re: 400 boxes of Surgical Equipment un­der B/L No. 3294, and 700 bags of Rice under B/L No. 29 ex m/v "Donbass"

I have to draw your attention to the fact that owing to the negligent and careless handling of cargo by stevedores much damage has been caused to the goods.

Due to improper slinging several boxes were crushed, some boxes dropped from the sling and were totally broken. As a result of inadmissible use of hooks a number of bags of Rice were badly torn and considerable leakage and loss ensued.

In the circumstances I have to make an official statement to the effect that my m/v "Donbass” has brought the cargo in good order and condition and that I shall bear no responsibility for any claims in connection with the above-mentioned damage which was caused to the goods in the course of such inefficient discharging.

At the same time I hold the Stevedoring Company, Messrs. Giovani Toscana & Co., Ltd., responsible for the damage caused and for all the consequences which may arise therefrom, of which I kind­ly request you to advise the said Stevedoring Company, Port Autho­rities, Consignees and all concerned.

4. Letter claiming urgent repairs of damage caused through in­competent handling of the winch

Dear Sirs,

I regret to inform you that owing to the incompetent hand­ling of the winch while discharging the cargo of Rails from Hold No. 2, to-day, at 2.00 p. m., your winchman, Mr. Olaf Olsen, crushed part of the deck superstructure and damaged the Fwd. port railing in the way of Hold No. 1 for a length of about 6 metres.

Therefore, I have to hold your firm responsible for the damage caused and to claim from you urgent repairs of that da­mage.

5.Letter to the Agents asking them to advise their Branch Office of me ship's expected arrival at their port

Re: 1500 tons of Sugar under B/L No. 172, consigned to order, by m/v ''Krasheninni-kow"

In accordance with the Charterer's instructions my vessel the m/'v "Krashenmnikov" will leave your port tomorrow at 15.00 hours for Nyrmshamn to discharge the above mentioned cargo there.

Please instruct your Branch Office at Nynashamn to make all the necessary arrangements for berthing and discharging my ves­sel as well as advising the Consignees and all concerned in due time.
