Charles Henderson (the nephew)

George Henderson’s nephew, Charles, had been warned by his uncle to change his “wild ways” or he would be cut out of the will. He had no keys to the mansion. He was secretly seeing Henderson’s housemaid, Claudine. He says he was at home alone watching a sports programme on TV Channel 3 between 9 and 11 pm.

Claudine Dupont (the maid)

George Henderson’s maid for the past two years, Claudine, was believed to be a reliable employee. She says she was washing Henderson’s supper dishes in the mansion’s kitchen at the time of the murder.

Charlotte Henderson (the wife)

Henderson and his wife Charlotte had been separated for seven months. She was not living in the mansion at the time of the murder, although she still had a key! The divorce was not yet final when the murder occurred. Charlotte believed she’d probably be awarded very little money in the divorce case. She says she was at the home of Henderson’s lawyer when the murder occurred.

Тема 7. Education and training

Упражнение 1. Прочитайте и переведите текст

A candidate wishing to become a solicitor first has to enroll as a student with The Law Society. Although it is not a necessary prerequisite, a large number of candidates seeking entry into the profession first take a law degree, which exempts them from a Common Professional Examination applicable in the case of non-law graduate.

After successful completion of the law degree, or CPE, or post-graduate Diploma in Law, would-be solicitors must undertake the Legal Practice Course which is the professional training for solicitors. This course takes one academic year, or two years if studied part-time. Again, competition for a place in the LPC is very tough. The course teaches the practical application of the law to the needs of clients, and is offered by a number of different colleges and universities.

Having successfully completed the Legal Practice Course, the would-be solicitor has to enter a two year training contract with a firm of solicitors or other approved organizations (such as a local authority or the Crown Prosecution Service), gaining practical experience in a variety of areas of law. At this stage they are paid a salary and are trainee solicitors.

The whole process of preparation for a law graduate in general takes six years: three years at University, one year at law school and two years in a solicitor`s office under articles of clerkship. For a non-law graduate it takes seven years, taking into account preparation for the Common Professional Examination.

Тема 8. The Law Society

Упражнение 1. Прочитайте и переведите текст

The Law Society is the professional body for solicitors. It was founded in 1825, and its governing body consists of a Council of 70 members. Membership of the Law Society is voluntary. The society supervises the training of articled clerks and is the examining authority for solicitors.

The Society maintains the Roll of Solicitors, issues annual practising certificates, and is responsible for granting or refusing consent to enrol students. The Society has statutory powers under which it exercises authority over all solicitors, whether they are member of the Society or not. For example, it makes rules regulating professional practice and the conduct and discipline of solicitors, administers a Compensation Fund for reimbursing those who suffer loss through defaulting solicitors, and controls a compulsory professional indemnity insurance scheme. Among the Society's public services are participation in law reform and administration of the National Legal Aid and Advice Scheme for which government money is provided to enable people with insufficient means to receive legal representation and assistance.

Solicitors are free to form partnerships and many in private practice organise themselves into partnerships of two or more partners. There are many firms with more than 20 partners and a number with over 50, all having a large supporting qualified staff. The profits of the partnership are divided between the partners in proportions agreed between them. The management of solicitors' offices is controlled and supervised by the solicitors themselves. In addition to the partners in a solicitors' office there will normally be assistant solicitors and clerical staff. There may also be a qualified accountant to look after the firms accounts with strict rules laid down by The Law Society.

Firms of solicitors are widely distributed throughout the country. There are many firms with offices in several towns. A number of firms also have offices abroad, in cities in Europe, the United States, the Middle East and the Far East. The number of solicitors in practice is steadily growing, the majority tending to join partnerships rather than to set up on their own.
